Giving birth is an incredibly joyous time for a family. However, all of this excitement and hope can be dashed instantly when parents and family learn the baby has suffered a birth injury. With such advanced medical techniques available, many people don’t realize giving birth still comes with serious risks for both mother and child. Unfortunately, these risks are heightened when a hospital and its staff fail to provide proper care to newborns.

One Wisconsin hospital is facing allegations of negligence after an investigation uncovered an extraordinarily high number of birth injuries. An investigation was started after reports to the Department of Safety and Professional Services alleged a nurse might have injured babies in the hospital’s Newborn Intensive Care Unit (NICU). The injuries varied from minor to severe, including bruising of the limbs, a broken arm, and even a skull fracture.

Unfortunately, this was not a one-time occurrence. The Centers for Medicare and Medicaid Services (CMS) began its own investigation, and through interviews with nurses and physicians as well as reviews of patient files found concerns about birth injuries in the NICU dated as far back as April 2017.

The most severe birth injury occurred in February 2017, when nurses began to notice strange bruising on an infant. Unfortunately, the bruising was neither reported nor investigated until several days later a CT scan of the child showed a bump on the head was an indication of a skull fracture.

These gross abuses may cost the hospital Medicare payments. CMS inspections found additional violations and the agency is threatening non-payment if the hospital cannot make proper corrections.

Hospital Negligence

It’s hard to believe a healthcare professional would intentionally harm a patient, particular a newborn, but the reality is it does happen. Hospitals have a responsibility to patients to keep them safe, and this includes keeping them safe from abuse caused by a healthcare professional.
